Health & Insurance Fund
The Insurance Fund is maintained through collective bargaining agreements with various contractors and Local No. 267 of the United Association of Journeymen and Apprentices of the Plumbing and Pipefitting Industry of the United States and Canada. These collective bargaining agreements provide that Employers must contribute to the Fund on behalf of each covered Employee on the basis of a fixed rate per hour worked. The Fund Office will provide you, upon written request, with information as to whether a particular Employer is contributing to this Plan on behalf of participants working under any collective bargaining agreement.
Income and Reserves:
Income received by the Fund from contributing Employers is held in a Trust Fund to provide benefits to covered Employees and their Dependents, and to defray reasonable administrative expenses. The Fund's assets and reserves are held in custody and invested by the Board of Trustees.
The Medical, Dental, and Disability benefits are provided through this self-insured Plan, administered by your Board of Trustees. The Plan's medical benefits are re-insured with stop-loss coverage. The Life and the Accidental Death and Dismemberment Insurance are insured through insurance carriers selected by the Trustees. If the Board, in its discretion, determines that such changes are required for the prudent administration of the trust Fund and the Insurance Plan.
Action of Trustees:
the Trustees have full and exclusive discretionary authority to determine eligibility for benefits and to construe the terms of this Plan. The Trustees are the sole judges of the standards of proof required in any case and of the application and interpretation of this Plan. Decisions of the Trustees are final and binding on all of the parties, and cannot be overturned or revered unless a court determines that they were arbitrary and capricious.
The Trustees may amend this Plan at any time by vote in accordance with the provisions of the Trust Agreement. Any such amendment shall be evidenced by an instrument in writing signed by one or more union Trustee, and one or more Employer Trustee in accordance with the provisions of the Trust Agreement.
